New rulebook in FBiH: Energy permit only for FNE above 1 MW

Solar power plants with an installed capacity of less than 1 MW no longer need an energy permit. The Ministry of Energy, Mining and Industry of the FBiH adopted the Rulebook on Issuing Energy Permits, which entered into force on July 6, 2024. The Regulation on the procedure, criteria, form and content of requests for issuing energy permits for the construction of new and reconstruction of existing facilities (“Official Gazette of the Federation of Bosnia and Herzegovina”, number 27/14) is hereby repealed.

The rulebook regulates the criteria for issuing an energy permit, the content of the request, and the manner and procedure of issuing an energy permit, the content of the energy permit, and the manner of keeping the register of issued energy permits in the Federation of Bosnia and Herzegovina. The provisions of this Ordinance also apply to the reconstruction of existing solar power plants.

An energy permit is not required for the construction of an electric power facility for the production of electricity with an installed capacity of less than 1 MW, except for hydroelectric power plants. Who is issued an energy permit?

An energy permit is issued to an applicant who proves that he meets the criteria related to:

a) type and use of primary energy sources,

b) safety of the power system, plant and supporting equipment,

c) the possibility of connection to the electric power system,

d) location and land use,

e) environmental protection and ensuring permanent control of the impact on the environment,

f) energy efficiency,

g) eligibility of the applicant,

h) contribution to the fulfillment of goals in the use of renewable energy sources,

i) contribution to the reduction of emissions of greenhouse and harmful gases and particles.

The energy permit is issued by the Ministry of Energy, Mining and Industry of the FBiH, and it is valid for 5 years.
